Yes, a person can always move out, but they are still responsible for paying the rent even if they do move out. The landlord doesn't sue to keep the person there, he sues to get the rent money promised in the lease. The whole reason the landlord wants a lease is so he CAN sue people who don't pay their rent. If the apartment sits empty and the landlord doesn't sue, that's hundreds of dollars he's not making. If enough apartments sat empty the landlord wouldn't be able to pay the mortgage and other bills. Even if the landlord can't find the person to collect the judgement, the court order still shows up on their credit report, ruining it.
