you are entitled under rent stabilization to a replacement refrigerator that works...it must be at least the same size as the old one... it does not have to be a new one... however, if the landlord is unable to repair or replace it, then he must buy you a new one out of his pocket and not yours....

if you did not like or want the replacement refrigerator and it was the same size and it worked well, then that is different... in that case the landlord could charge you for a new one and you would pay the fee for the entire term that you lived there... if the ice box cost 200 for an example and you spent 1/40 'th per month the legal amount that is $5 per month or $ 60 a year if you stayed 10 years it would cost you $600 if you stayed 20 years it would have cost you $1,200...

if you don't like the replacement FREE ice box you may ask the landlord if you could buy your own........ the ice box broke down due to normal wear and tear and is probably over 30 years old.... tell him to REPLACE it with the same size one in good working order for FREE.... www.oag.state.ny.us/realestate/tenants_rights_guide.html
