I don't understand, why would he be giving you back any rent. By your last months rent do you mean your deposit? Are you moving out? Have you made late payments? You could put more info. But if your lease says 25.00 and it's still current then the late fee is 25.00. He can't explain away a written document in court. And if he causes you to go to court over this make sure you get compensated for your losses and court costs.

However, if you wrote him a bad check that might be different?? More info????
