It sounds like you do, as the landlord didnt mitigate his damages (if that is the right terminology, as I am not a lawyer). It sounds like unfair conduct, so why not give it a shot.
This board is mainly for residential tenants, by the way. Not to discourage your query, but I think most of the people who follow this board--to the extent they have any expertise at all--have expertise on residential r.e. issues in NYC.
