All stabilized apartments have a legal rent. However, for whatever reason a landlord may chose to offer a potential renter lower rent. This can be because of market, he likes the way you dress, you negotiate well. All increases due the rent-boards annual decision should be based on this preferential rent...not the legal rent. When you vacate the apartment the landlord can go back to charging the legal rent, plus any board sanctioned increases based on the legal amount, and finally vacancy increases.
The intitial poster rent increase should be based on her preferential rent not the legal rent...this oversight may or may not be intentional but should be brought to the attention of the landlord.
