lease renewal

NYC, rent stab. My landlord gave me the lease renewal too late. I corrected the lease, sign it and returned it to him with a letter stating that due to his delay in providing the renewal, the lease period had been pushed forward. I made the corrections on the lease, initialled and asked him to return the executed copy, with the initialled changes back to me. He did not return the lease and the commencement date has come and gone. I have continued to pay the old rent, he has deposited my checks, but always almost a month late. My question is, should I contact the DHCR and place a formal complaint against him for failure to provide a lease extension or should I continue to pay the old rent? Is there anything legal he can do to me for the rent difference, or the fact that he never returned the executed lease renewal mean that the old lease is still in effect?
