security deposit

Posted by Josh Kaplan on August 01, 2000 at 16:51:41:

I've been renting a 1 BR apt. in Rockland County, NY (no rent stabilization or rent control) for 13 mos. My lease expired at the end of June and the landlord did not ask me to extend it. I found a new place in the middle of July and notified the landlord on about July 20 that I'd be out by the end of the month. Although the expired lease says nothing about giving 30 days notice, the landlord says that I'm only entitled to half of my 2 mos. security deposit since I didn't provide enough time to find another tenant. Does anyone know what the law says about month-to-month tenants in my situation? Must one give 30 days notice if it was not agreed upon in the original lease?

Any suggestions would be much appreciated.

Josh
