my East VIllage, NYC, non rent regulated apt building has been infested with rats for the past two months. at least two rats have repeatedly eaten through the sheetrock wall of our newly renovated apt and hung around under our kitchen sink. numerous attempts were made to contact the landlord, resulting only in the super coming over and patching up the hole (not everytime, and after several days of waiting, after which the rats would eat back through. also, a back patio area that we pay for has been unusable due to the rats running around it. after a month of begging for help, we finally called the exterminator who came and put out some traps. some attempts have now been made to clean up the builidng and the garbage, although rats are still around the trash. finally we sent a certified letter to the landlord saying we woudl pay no more rent until the problem was rectified. he is now saying that we have to pay him all back rent (1 and 1/3 month) immediately or he will take us to court. do we have a case???? please help
