The reason the lawyer is telling you to pay the fee and then withold it is to get you into the apartment legally and then force the landlord to have to deal with you once you have a signed lease and the landlord is stuck (sleazy). The landlord has every right to ask everyone to vacate the apartment once the primary leaves, get a vacancy increase and then rent to someone new in a very tenant rich market. Letting you stay thay are doing you a favor. Getting them mad is a bad idea.

Have you been in the apartment over 2 years?
