I know you're trying to be helpful, but telling this fellow to "get a lawyer" to answer that one solitary question is not the purpose of this message board, with all due respect. I can understand his frustration. I think we should be encouraging people to post here, not to tell them, in effect, to get lost.

As for your answer to my question--what "separate proceeding" are you talking about? There is, to my knowledge, only an enforcement action, which is totally up to the DHCR and is not something the tenant can initiate. If I am wrong, please let me know.
