A bathroom doesn't have to have a window if it's part of a ventilation system -- usually a fan on the roof, attached to a duct, with an air vent in each bathroom without a window.

You should check with the Buildings Department to see if your building has a Certificate of Occupancy for its current configuration of five units. If it doesn't, you may want to contact a lawyer about withholding your rent. You and your neighbors might eventually be evicted, but you might not have to pay any rent or use and occupancy for your remaining time in the building.

: I am a tenant in a illegally converted studio apartment in a Brooklyn brownstone. The house has four studio apartments in addition to the owner's unit. The studios were put in approximately seven to ten years ago. I have a written lease. Three of the studios have bathrooms with no windows. Is that a violation of NYC or state housing code?
