It has been over 30 days since we moved out of our rental house and our landlord has not returned our security deposit, nor has he given us a letter stating "why" we haven't received our deposit back. Isn't he breaking some laws? When we gave him our letter notifying him that we were vacating the premises at the expiration of our lease, we included our address so he could mail our security deposit to us. We have had a lawyer call him, and he told the lawyer that he never received notice from us that we were moving out, then he hung up on our lawyer. My husband "hand-delivered" our notice to vacate letter to him because in the past when we had tried to send him certified letters, he wouldn't accept them. We also went to our former landlord's store to ask him when we were getting our money back and he told us to get out or he would call the police. We were going to take him to small claims court, but we are in the military and have to move soon, so we're unable to take him to court. What can we do to get your money back? We're afraid if we hire an attorney to take care of this matter for us, that our former landlord will just lie his way out of it, and we'll end up losing more money. He has no reason to keep our money. We paid our rent on time EVERY month, took care of the house, and it was ten times cleaner when we moved out then when we moved in. He never fixed anything, we went without heat for over a month, and that's just the "tip of the iceberg". If anyone can help answer our questions about getting our security deposit back, we would sincerely appreciate it. Thanks.
