Unless you got the repair/painting promise in writing, you're probably out of luck: your lease probably says 'as is'.

One exception: in NYC: as part of the lead-based paint abatement law passed last summer: the floors must be smooth and, if there is peeling paint, the paint repaired BEFORE you move in. Read that law on Tenant.Net.
