It is illegal in Mass to collect rent from two tenants for the same month.
Can they collect the break-lease fee? Maybe: it depends on the wording of your lease clause.

Another point: landlords in both Boston and NYC are notorious for NOT returning tenants' security deposits, forcing us to sue them in Small Claims: is that 'last month's rent' in addition to a deposit?

Lastly: closings get delayed more often than not: don't release the apartment until the vacant house's deed is delivered...
