Brokers fee is not collectable until the lease is signed and you take possession, if memory serves.

Search here for 'broker' for links: either the Attorney General or the Dept of State take complaints about them: they can lose their license. Or try the Consumer page on http://www.ci.nyc.ny.us/ one or several of these sites spell everything out in plain english.

As far as Small Claims: good advice in the Housing Court section on TenantNet.
probably good idea to send them a bill or demand for payment (by xx date or we'll sue...) first, USPS certified, RRR or certificate of mailing.
