You don't say where you live. Read your lease. It usually provides for delays like this. Can't you holdover, just like the current tenant in your new apartment is doing? This is a very common situations in houses, apartments, offices, and stores.

My lease should have started with the new owner 15 days ago. Is there any legal action that I can take? He has my two month security too.
