Construction in building

The building owners have been refurbishing apartments one by one (the super does the construction). I moved in two months ago and the 1st re-do was across the hall. It took weeks and was very loud. Now they're doing the place downstairs, 5 weeks total they say, 2 weeks to go and more apts will be done after that. It's 9pm on a Tuesday and they're hammering the ceiling (my floor), very loud. Aren't there any guidlines on when they can do this? They work on weekends, until 9pm daily. I called the landlord finally and he said "well if you weren't home so much lately it wouldn't bother you" - I freelance at home sometimes. He said that he'd tell them not to work past 8pm anymore, still seems late. I pay alot of rent, was never warned about this and its not rent stabilized or controlled - just doesn't seem fair.
