Proper procedures for withholding rent

Posted by Maria on March 22, 2000 at 17:34:06:

Help!!! I am looking for guidance in regard to the best was of hadleing this situation.
I live in Philadelphia, Pa. In an apratment building that has 15 other units. It is not a rent controled property. Many repairs in the building ( documented by Licence and Inspection) and in my own apartment have gone without fixing. I have given my landlord written notice that becasue of this I was going to withhold rent. In the letter I let them no that it would be in an escrow account, which I will give them a copy of each month showning the rent deposit and that the money would remain there until all repairs are made.

Could some one let me know:
1- Did I handel it correctly.
2- If I did do it correctly what should I do if they try to evict me.
3- If i didn't do it the right way, how sholud I hadel it?
$- Is it true that if they don't make the repairs with in six months that the money is mine to keep.

I have 6 months left on my lease. I love the area that I am in. It a very quite section of Phildelphia. My 8 year old daughters school is right across the street. I realy don't want to move.

Again, Help!!!
I would appreciate any advise.
