can landlord keep sec dep on broken lease

Posted by andrew on March 10, 2000 at 14:38:04:

NYC, condo, Hell's kitchen: My landlord decided to sell the apt I had been renting for four years. He said he would honor the lease to the end. Four months prior to the end of the lease I found another apt and broke the lease. The landlord said he would have to rush to sell the apt, that each month would cost his maintenance. He said he would keep my sec deposit for a month's liability unless he closed on a sale of the apt within 30 days, in which case he would return it to me. Is this legal?
