Is this a co-op or a condo? Do you or your noisy neighbor have a lease?

If your noisy neighbor is under a month-to-month lease, the landlord just has to give 30-days written notice in New York City and one-month's notice in the rest of the state to terminate the lease, without cause.

Even if there is a longer lease, the landlord can bring an eviction proceeding in civil court or an injunction proceeding in supreme court to quiet your noisy neighbor. You are entitled to quiet enjoyment of the premises. The landlord has an obligation to remedy the situation.

: In New York, does a landlord have a duty to quiet down noisy neighbors if such landlord is the common owner of the noisy unit and the complaining unit? (I know that's the case under Mass. law, but not sure about NY)
