When you sign a house into someone elses name to prevent someone else from making a claim on it you better trust the person you are signing your life away to. If you ask me the difficulties started when your stepfather tried side stepping his wife's rights.

As far as the eviction goes have you guys ever paid rent? Who paid the mortgage on the house? If you have never paid rent and have any proof that your stepfather paid the mortgage there is no evidence that you are tenants. In fact unless you signed anything resembling a lease there isn't a court around that will claim that you are even tenants. You are simply family who are living together. it then becomes a civil matter. This is particularly true if you didn't pay rent and I am assuming that you did not if he sued for non payment. Don't worry yourself, judges cannot throw family members out on the street! The real crazy person is your step dad's dad's lawyer, thinking he has any kind of a case. He is just taking the old mans money.
