from sublease to lease

I have heard that if your landlord cashes at least three checks directly from your account, you defacto become the leasee. Any thuth to this?
I have been subleting for over a year and paying the past tenant a hefty premium despite the fact that she has no intentiopn of coming back to New York.
I am thinking of sending the landlord this months rent directly and seeing what happens.
Your insight would be appreciated.
