SUBLET IN NYC -- UNUSUAL SITUATION

Posted by marina harss on January 12, 2000 at 12:33:30:

I've been living in the same apartment in NYC for 3 years, under unusual circumstances. It is a large building with many units. The lease to my apt. is held by a great-aunt, who also leases another apartment in the same building. She lives in that other apartment, and sublets this one to me (therefore the other apartment is her primary residence). Three years ago, we went together to the building management to request permission for her to sublet the second apartment to me. We filled out an application, and never heard back from them, despite frequent calls from both of us. So I have been simply living there, paying my rent to her. Is this an illegal sublet? And do I have any rights in this situation (i.e. could I be evicted?).
