What Is Mediation ?

Mediation services, one of the many services offered by Western Michigan University helps people resolve conflicts related to rental housing.

The Mediator is a knowledgeable consultant, who attempts to convert an argument into productive discussion. The Mediator has the courage to disagree with touchy issues and keeps a sizable file of current information about rental housing.

The Mediator, after listening to all sides of the dispute, will document (1) what the issues are, (2) a recommendation for settlement, and (3) the reasons for the recommendation. The recommended settlement will be based on what is viewed as fair, practical, and expedient. Parties to a dispute in mediation do not waive their right to pursue a legal settlement.


Before Mediation

Step I - Get Information
  1. Read your lease, inventory inspection checklist and all other relevant documents.
  2. Talk with your landlord.
  3. Read the Off-Campus Life brochure(s) on the specified issues(s) in question.
  4. Call or come in to Off-Campus Life for advice.

Step II - Try To Work It Out With Your Landlord

  1. Ask questions.
  2. Be business-like -- no yelling; try to listen.
  3. Try to compromise.
  4. Get answers in writing, signed and dated.

If This Doesn't Work ...

Step III - Request Mediation Services

  1. Fill out "Mediation Request" form. Include names and addresses of all parties, dates and other basic information concerning the problem.
  2. Schedule appointment with Mediator to discuss case.
  3. Bring all relevant documents; lease, inventory checklist, canceled checks, etc.
  4. If advised to do so by the Mediator, sign "Tenant Escrow Agreement" form and pay rent into escrow account.

Mediation Process

  1. Copy of complaint sent to other side(s). They are asked to call Mediator. If deemed necessary, immediate phone contact will be attempted.
  2. If party does not respond within four (4) work days, Mediator will attempt to contact party again. If not successful, recommendations will be made based upon available information.
  3. Discussion of facts with both sides.
  4. Other parties contacted as needed - building inspector, etc.
  5. "Conflict Resolution Recommendation" is developed by Mediator, identifying issues, recommendation(s) and the reasons for the recommendation(s).
  6. All parties receive a copy of the "Conflict Resolution Recommendation".
  7. Parties accept recommendation or are encouraged to settle the matter in court.
  8. If escrow was used, distribution of money by Mediator in accordance with the recommendation or a court judgment.
