OPERATIONAL BULLETIN NO. 84-3 (REVISED FEBRUARY 14, 1986)

NEW PROCEDURES FOR THE IMPLEMENTATION OF THE FREEDOM OF
INFORMATION LAW (FOIL) AND PROCEDURES FOR RESPONDING TO SUBPOENAS
DEUCES TECUM FOR LEGAL FILES AND RECORDS


1)   Ms. Peggy Shepard is hereby designated as the records Access
     Officer of the Office of Rent Administration, Division of
     Housing and Community Renewal, 92-31 Union Hall Street,
     Jamaica, New York 11433.

2)   All FOIL requests to review files, documents, etc. must be
     in writing, on at least five (5) days prior notice, and
     addressed to the Records Access Officer at the above
     address.

3)   The FOIL request must specifically describe the item
     requested and, if known, its location.

4)   Within five (5) business days of receipt of the FOIL
     request, the Records access officer will notify the
     requester, in writing, whether the request has been granted
     or denied.

5)   If the FOIL request has been denied, the requester may
     appeal such denial to the designated Appeals Officer within
     thirty (30) days of issuance of the denial.

6)   Nathaniel Geller, Assistant Deputy Counsel, Office of Rent
     Administration, Division of Housing and Community Renewal,
     92-31 Union Hall Street, Jamaica, New York 11433, is hereby
     designated Appeals Officer.

7)   The appeal must be determined within seven (7) business days
     of receipt of the appeal.

8)   If the FOIL request has been granted, the requester will be
     advised, in writing, within five (5) days of making such
     request that the requested records may be inspected in
     accordance with the procedure set forth in item "9" herein.

9)   The Records Access Officer will ascertain and/or confirm the
     location of the file or other documents requested and advise
     the requester, in writing, of the location thereof, the name
     of the person who has possession of the documents, and that
     such documents may be reviewed from Monday through Friday
     between the hours of 9:00 A.M. and 4:00 P.M. or at a
     specified date and time.

10)  A requester who wishes to obtain copies of the requested
     documents shall be charged $.25 per page.

11)  Prior to inspecting the requested documents, the requester
     must complete and sign the Division's form OS-97R,
     Application for Public Access to Records.

12)  If copies of the requested documents are sought, the person
     receiving payment for such copies must complete the
     Division's Receipt, form OS-97a, and give the requester a
     copy of the Receipt.

13)  Parties to a pending proceeding or their legal
     representatives who wish to inspect their file, should give
     the Division seventy-two hours advance notice. "Parties" are
     defined as the owner, tenant or an attorney of either who
     has filed a Notice of Appearance with the Division.

14)  Parties to a pending proceeding should direct requests to
     inspect their file to the Public Information Unit of the
     District Rent Office at which their file is located.

15)  The addresses and telephone numbers of the District Rent
     Offices are attached.

1)   Persons seeking to serve subpoenas on this agency should be
     directed to the appropriate District Rent Office and
     subpoena officer.

2)   This agency will not respond to a subpoena unless it is
     marked "So Ordered" and signed by a Judge of the court
     issuing the subpoena;

3)   Subpoenas must be issued at least 24 hours before the return
     date so as to enable the agency to locate the requested
     files and/or records; process the files and/or records for
     delivery to the appropriate courthouse; and make delivery to
     the appropriate courthouse.

4)   Subpoenas should be responded to by photocopying the
     contents of the file and/or record; comparing the copy with
     the original; certifying the copy; delivering the certified
     copy of the file and/or record to the record room of the
     appropriate courthouse on the return date.

5)   For the purposes of certifying copies of original documents,
     as stated in paragraph 5, the Subpoena Officers have been
     appointed certifying officers.

6)   If the subpoena officer is unable to comply with the record
     requested, a letter shall be sent to the court advising the
     judge of that fact, requesting additional time to comply.

7)   All questions which may arise concerning the validity of the
     subpoena that cannot be resolved by the subpoena officer
     shall be determined by either of the Assistant Deputy
     Counsels. If neither of them are available and time is of
     the essence, then tile Deputy Counsel or a Bureau Chief may
     be consulted.
