ORDER AND OPINION TERMINATING PROCEEDING
On December 1, 1993, the above-named landlord filed a
petition for administrative review of the rent agency's response
to the landlord's request for registration information and of the
subject apartment's Registration Cards, concerning the housing
accommodation known as Apartment 4D, 371-95th Street, Brooklyn,
New York.
The Commissioner notes that the rent agency's response to
the landlord's request for registration information and the
subject apartment's Registration Cards are not orders of the rent
agency. The Commissioner further notes that the above-mentioned
items do not make a determination on the merits, but they merely
restate the rights and obligations already existing between the
subject landlord and the tenant.
As there has been no order issued by the Administrator in
this proceeding for the Commissioner to review, the Commissioner
is accordingly of the opinion that this proceeding should be
terminated.
The Commissioner notes that this order is issued without
prejudice to the landlord's right to request an administrative
determination, upon written request to the Administrator of the
rent agency's Owner Individual Unit, to reconsider the subject
tenant's maximum rent, pursuant to Section 2202.22 of the City
Rent and Eviction Regulations. The Commissioner points out that
the issues raised in the landlord's petition for administrative
review may properly be raised in an administrative determination.
THEREFORE, in accordance with the provisions of the City
Rent and Rehabilitation Regulations, and the Rent and Eviction
Regulations, it is
ORDERED, that this proceeding be, and the same hereby is
terminated.
