ORDER AND OPINION TERMINATING PROCEEDING AS MOOT
On April 27, 1989 the above named petitioner-owner filed a
Petition for Administrative Review against an order of the Rent
Administrator issued March 17, 1989. The order concerned various
housing accommodations located at 240 E. 21st Street, New York,
N.Y. The Administrator granted the owner's rent restoration
application.
The Commissioner notes that the owner filed an administrative
appeal against the rent reduction ordered by the Administrator in
Docket No. BD430083B. In Docket No. CB430230RO the Commissioner
granted the petition and revoked the rent reduction order ruling
that the evidence of record did not support a finding of failure to
maintain services for which a rent reduction is warranted. The
Commissioner's decision revoked the rent reduction in that
proceeding rendering the issue of rent restoration moot.
Therefore, this administrative appeal proceeding is terminated.
THEREFORE, pursuant to the Rent Stabilization Law and Code and
Rent and Eviction Regulations for New York City it is
ORDERED, that this proceeding be, and the same hereby is,
terminated as moot.
