ORDER AND OPINION TERMINATING PETITION FOR ADMINISTRATIVE REVIEW
On November 5, 1993, the above-named petitioner-tenant filed a
timely Petition for Administrative Review (PAR) against an order
issued on October 26, 1993, by the Commissioner concerning the
housing accommodation known as 229 West 71st Street, Apt. 2F,
New York, New York, wherein the Commissioner denied the owner's
petition against the rent reduction order (Docket No. CI410603S).
The petitioner is advised that a petition for administrative review
may not be filed against a Commissioner's order which is a final
agency determination that can only be reviewed in a court of
competent jurisdiction in a proceeding brought pursuant to Article
78 of the Civil Practice Law and Rules.
THEREFORE, in accordance with the Rent Stabilization Law and Code,
it is
ORDERED, that this petition be and the same hereby is terminated.
