         ORDER AND OPINION TERMINATING PETITION FOR ADMINISTRATIVE REVIEW


      On July 9, 1993 the above-named owner filed a Petition for 
      Administrative Review against an order issued on June 14, 1993, by the 
      Rent Administrator concerning the housing accommodations known as
      43 East 74th Street, Apt. 2B, New York, New York wherein the 
      Administrator determined the owner had overcharged the Tenant. 

      Subsequent to filing this petition, the owner advised the Division of 
      Housing and Community Renewal that a settlement had been reached, and 
      that the owner requested withdrawal of his petition.

      The Commissioner is of the opinion that the request for withdrawal 
      should be granted.

      THEREFORE, in accordance with the provisions of the Rent Stabilization 
      Law and Code, it is

      ORDERED, that this Petition be, and the same hereby is, terminated based 
      upon the owner's withdrawal.
