ORDER AND OPINION GRANTING PETITION FOR ADMINISTRATIVE REVIEW
IN PART AND MODIFYING RENT ADMINISTRATOR'S ORDER
On March 8, 1993 the above named petitioner-tenants filed a
Petition for Administrative Review against an order of the Rent
Administrator issued February 8, 1993. The order concerned various
housing accommodations located at 287 Linden Blvd., Brooklyn, N.Y.
The Administrator directed restoration of services and ordered a
reduction of the stabilized legal rents.
The Commissioner has reviewed the record and carefully
considered that portion relevant to the issues raised by these
appeals.
In Docket No. HC630006RT et. al, the Commissioner decided the
administrative appeals of 34 tenants in the building. The tenants
appealed the order here under review and requested modification
thereof to include certain enumerated conditions not cited in the
order. The Commissioner granted the petitions in part and modified
the order to include the fact that the building entrance door was
open. The order was also modified to reflect the fact that certain
apartment mailboxes were defective.
The petitioner tenants herein do not mention defective
mailboxes in the petition. They do cite the fact that the building
front entrance door is unlocked. Therefore, pursuant to the
Commissioner's decision in Docket No. HC630006RT, the order here
under review is modified to add the open entrance door to the list
of items which the owner is directed to restore.
THEREFORE, pursuant to the Rent Stabilization Law and Code it
is

ORDERED, that this petition be, and the same hereby is,
granted in part, and that the Rent Administrator's order be, and
the same hereby is, affirmed as modified herein.
