ORDER AND OPINION TERMINATING PROCEEDING
On January 26, 1993, the above-named tenant filed a petition
for administrative review of an order issued on January 8, 1993 by
the Rent Administrator concerning the housing accommodation known
as Apartment 1L, 70-34 66th Street, Glendale, New York.
By letter dated June 4, 1993, the tenant withdrew her petition
for administrative review. The Commissioner is accordingly of the
opinion that this proceeding should be terminated.
As to any refund in which the subject landlord may owe to the
subject tenant as a result of the Administrator's order in this
proceeding, the Commissioner notes that the tenant may bring an
action against the landlord in a court of competent jurisdiction,
pursuant to Section 2206.8(a)(2) of the City Rent and Eviction
Regulations, to collect the aforementioned refund.
THEREFORE, in accordance with the City Rent and Rehabilitation
Law and the Rent and Eviction Regulations, it is
ORDERED, that this proceeding be, and the same hereby is,
terminated.
