                 ORDER AND OPINION TERMINATING PROCEEDING ON APPEAL

          The above named petitioner-owner timely filed a petition for 
          administrative review (PAR) against an order issued on September 
          18, 1992, by the Rent Administrator (92-31 Union Hall Street, 
          Jamaica, New York) concerning the housing accommodations known as 
          190 Hancock Street, Brooklyn, New York, various apartments, wherein 
          the owner's application for a major capital improvement (MCI rent 
          increase was denied.

          The Commissioner notes that the Rent Administrator reopened the 
          proceeding on October 29, 1992, under Docket No. GJ230016RK, 
          reprocessed the owner's application, and then issued an order on 
          April 8, 1994 granting the owner's application and, in so doing, 
          the relief requested in this petition. 

          In view of the foregoing, the Commissioner is of the opinion that 
          the owner's administrative appeal against the original decision of 
          the Administrator under Docket No. EI230037OM should be terminated 
          as moot.  Any aggrieved party had the right to timely file an 
          administrative appeal against the order issued under Docket No. 
          GJ230016RK within 35 days of its date of issuance.

          THEREFORE, in accordance with the applicable provisions of the Rent 
          Stabilization Law and Code, it is

          ORDERED, that this administrative appeal proceeding be, and the 
          same hereby is, terminated.
