          ORDER AND OPINION TERMINATING PETITIONS FOR ADMINISTRATIVE REVIEW


          On September 1, 1992, the above named petitioner-tenants filed 
          administrative appeals against an order issued on July 29, 1992 by 
          the Rent Administrator (Gertz Plaza, Jamaica, New York) concerning 
          the housing accommodations known as 382 Central Park West, New 
          York, wherein the Rent Administrator granted the owner's 
          application for a rent increase based on the installation of a 
          major capital improvement (MCI).

          Thereafter the Administrator granted the tenants' request for 
          reconsideration based on an "irregularity in vital matters " and, 
          on December 17, 1993, the Rent Administrator issued an order of 
          revocation (Docket Number: GK430011RK), revoking the order issued 
          July 29, 1992 and the rent increase provided for therein predicted 
          on the grounds that the offering plan stated that the improvement 
          or improvements would be made at the sponsor's "sole expense" or 
          "sole cost and expense".

          There is, therefore, no issue to be determined herein.

          THEREFORE, in accordance with the Rent Stabilization Law and Code 
          and the New York City Rent and Eviction Regulations, it is

          ORDERED, that these petitions be, and the same hereby are, 
          terminated.
