         ORDER AND OPINION TERMINATING PETITION FOR ADMINISTRATIVE REVIEW

      On July 1, 1992, the above-named petitioner filed a Petition for 
      Administrative Review (PAR) against an order issued on June 5, 1992     
      by the Rent Administrator.

      The proceedings were originally commenced by the filing by the tenant of 
      two complaints of owner's failure to renew lease.  The first complaint 
      was received by the DHCR on April 30, 1992, under Docket No. GD 610017 
      RK.  The second, received on the same date, was assigned Docket No. GD 
      610025.  On June 5, 1992, the Rent Administrator issued its order 
      directing the renewal of the lease, which order is the subject of the 
      instant proceeding, under Docket No. GD 610025-RV.

      In a so-ordered stipulation of settlement entered into before Bronx 
      County Civil Court, Housing Part 18 (Index L&T 81712/92) Carol 
      Management Corp. and the tenant, on July 28, 1992, agreed to withdraw 
      any and all actions pending before the DHCR concerning the subject 
      premises, and to deem those actions settled by entering into that 
      stipulation.

      Section 2520.13 of the Rent Stabilization Code states, in pertinent part 
      that based upon a negotiated settlement betwen the parties and with the 
      approval of a court of competent jurisdiction where a tenant is 
      represented by counsel, a tenant may withdraw, with prejudice, any 
      complaint pending before the DHCR.

      By order dated September 2, 1992, the proceeding under Docket No. GD 
      610017 RK was terminated, pursuant to the above-referenced Court order.

      The Commissioner finds that the withdrawal is in compliance with the 
      statute, and that administrative appeals Docket No. GG 610035-RO should 
      be terminated.

      THEREFORE, in accordance with the the Rent Stabilization Law and Code,
      it is

      ORDERED, that this petition be, and the same hereby is, terminated.
