                       ORDER AND OPINION TERMINATING PROCEEDING


      On May 1, 1992, the above named petitioner-tenant filed a Petition for 
      Administrative review against an order issued on April 2, 1992, by the 
      District Rent Administrator, 55 Church Street, White Plains, NY concerning 
      housing accommodations known as Apartment 47 at 455 North Broadway, Yonkers, 
      NY.

      On October 6, 1992 the tenant signed a general release of the owner 
      regarding the subject DHCR Docket No. YEJ-9-1-0185-R.  

      Said release was in consideration of both a cash settlement, and the owner's 
      withdrawal of his PAR of the same order under Docket No. GE 910275-RO.

      The Commissioner is accordingly of the opinion that this proceeding should 
      be terminated.

      THEREFORE, in accordance with the Emergency Tenant Protection Act, it is 

      ORDERED, that this proceeding be, and the same hereby is terminated.
