ORDER AND OPINION TERMINATING PROCEEDING AS MOOT
On April 14, 1992 the above named petitioner-owner filed a
Petition for Administrative Review against an order of the Rent
Administrator issued April 8, 1992. The order concerned various
housing accommodations located at 1920 McGraw Ave, Bronx, N.Y. The
Administrator denied the owner's rent restoration application.
The Commissioner has reviewed the record and carefully
considered that portion relevant to the issues raised by this
appeal.
The Commissioner notes that the owner filed an application for
rent restoration which was assigned Docket No. DC610163OR. The
Administrator issued an order granting the application in part for
rent controlled tenants and denying it for rent stabilized tenants
based on physical inspections which found peeling paint and plaster
on the bulkhead wall of Section "B". The owner filed an
administrative appeal of this order (Docket No. EL630083RO). The
Commissioner granted the appeal and ordered complete rent
restoration for all rent controlled and rent stabilized tenants.
The Commissioner's decision in Docket No. EL630083RO renders the
owner's appeal herein moot. This proceeding is, therefore,
terminated.

THEREFORE, pursuant to the Rent Stabilization Law and Code and
Rent and Eviction Regulations it is
ORDERED, that this proceeding be,and the same hereby is,
terminated as moot.
