ORDER AND OPINION TERMINATING PETITIONS FOR ADMINISTRATIVE REVIEW
The above named petitioners-tenants timely filed Petitions for
Administrative Review against an order issued on December 9, 1991 by the
Rent Administrator, Gertz Plaza, Jamaica, New York, concerning housing
accommodations known as 98 Riverside Drive, New York, various apartments.
The said order issued on December 9, 1991 under Docket No. FD 430034-RK
modified an order issued on March 19, 1991 under Docket No. BL 430341-OM.
Subsequently the tenants through their tenants' Association requested a
reconsideration to reopen and further modify the order issued under Docket
No. FD 430034-RK. A search of the record reveals that the Administrator
issued a notice (Docket No. GE 430001-RK) on May 7, 1992 reopening the
proceeding under Docket No. FD 430034-RK for further processing. As the
matter is still pending before the Administrator, the Commissioner is of
the opinion that these Administrative Appeals should be terminated as moot.
This order and opinion is issued without prejudice to the right of any
aggrieved party to timely file an Administrative Appeal against the
Administrator's order under GE 430001-RK, when issued.
THEREFORE, in accordance with the Chapter 403 of the Laws of 1983, as
amended by Chapter 402 of the Laws of 1984, as implemented by Operational
Bulletin 84-1, it is
ORDERED, that this petition be, and the same hereby is, terminated as moot
in accordance with the above.
