                  ORDER AND OPINION TERMINATING PROCEEDING AS MOOT
                                          
               On September 18, 1992 the above named petitioner-tenant filed 
          a Petition for Administrative Review against an order of the Rent 
          Administrator issued September 16, 1992. The order concerned 
          housing accommodations known as Apt 419 located at 1620 Avenue I, 
          Brooklyn, N.Y.  The Administrator granted the owner's rent 
          restoration application. 

               The Commissioner has reviewed the record and carefully 
          considered that portion relevant to the issues raised by this 
          appeal.

               The owner commenced this proceeding on February 20, 1992 by 
          filing a rent restoration application wherein it stated that it had 
          restored services for which a rent reduction order bearing Docket 
          No. CK230085B was issued. The rent had been reduced, in part, based 
          on the owner's failure to provide doorman service. 

               The Commissioner notes that, in Docket No. EJ230006OR, the 
          Administrator granted the owner's rent restoration application in 
          part and ordered rent restoration of $11.00 per month.  The owner 
          was advised to reapply for the remaining $5.00 per month when it 
          restored the doorman service.  The owner took an administrative 
          appeal from this order.  In Docket No. FJ230007RO the Commissioner 
          granted the owner's appeal and ordered full rent restoration 
          effective October 1, 1991.  The Commissioner ruled that a DHCR 
          Compliance hearing held on September 16, 1991 established that the 
          owner had restored the doorman service.

               The Commissioner's decision in Docket No. FJ230007RO, wherein 
          the rents were ordered restored effective October 1, 1991, renders 
          the administrative appeal filed by the tenant moot.  Therefore, the 
          Commissioner terminates this proceeding.

               THEREFORE, pursuant to the Rent and Eviction Regulations for 
          New York City it is 

               ORDERED, that this proceeding be, and the same hereby is, 
          terminated as moot.
