ORDER AND OPINION DENYING PETITION FOR ADMINISTRATIVE REVIEW
On February 3, 1992, the above-named petitioner-owner filed a
petition for administrative review of an order issued on January
22, 1992, by the Rent Administrator, concerning the housing
accommodation known as 985 Ocean Avenue, Brooklyn, New York,
Apartment 1-F, wherein the Administrator amended and superseded an
order issued on June 24, 1985 to reflect the correct status of
Apartment 1-F only, as rent controlled rather than rent stabilized,
and to state a dollar rent reduction amount of $47.00, plus 7 1/2%
of the maximum legal rent (MLR), effective the first rent payment
date following June 24, 1985. In all other respects the June 24,
1985 order remained in full force and effect.
The owner's request that the order be modified to reflect that
services have been restored per Docket No. EC 230114-OR does not
address issues resolved in the initial rent reduction order issued
on June 24, 1985, nor in the January 22, 1992 amended order herein
under review.
It is noted, moreover, that the owner's request that the order
reflect that services have been restored has been addressed in the
order of the Deputy Commissioner, per Docket No. FA 230013-RO,
remanding the rent restoration proceeding under Docket No. FA
230114-OR to the Administrator to compute the dollar amount of
partial rent restoration for Apartment 1-F, effective the first
rent payment date after December 18, 1990.
The owner is also advised to file an application for rent restora-
tion for any remaining services that have been corrected since the
December 18, 1990 order.

THEREFORE, in accordance with the provisions of the Rent Stabiliza-
tion Law and Code, and of the City Rent Control Law, and the Rent
and Eviction Regulations for New York City, it is
ORDERED, that the owner's petition be, and the same hereby is,
denied, and that the Administrator's order be, and the same hereby
is, affirmed.
