           ORDER AND OPINION TERMINATING ADMINISTRATIVE REVIEW PROCEEDING  


          On December 30,  1991,  the  above-named  owner  filed  a  timely
          petition for administrative review of an order issued on November 
          25, 1991, by a Rent Administrator concerning the housing accommo 
          dation known as Apartment 5-C, 36 Plaza Street, Brooklyn, 
          New York.

          The Commissioner has reviewed all of the evidence in  the  record
          and has carefully considered that portion of the record  relevant
          to the issues raised by the petition for review.

          The Commissioner notes that on May 15, 1992, Rent Administrator's 
          proceeding Docket No. EI 210410-S was reopened by the Rent Admin 
          istrator pursuant to Section 2527.8 and was assigned a new docket 
          number GE 210005-RP.

          Accordingly, the Commissioner finds that the instant petition  is
          premature and that this administrative review  proceeding  should
          be terminated.

          The parties are advised that the previously issued order and  the
          stay on the retroactive portion of the rent reduction remains  in
          full force and effect until a new order is issued.






          THEREFORE, in accordance with  the  Rent  Stabilization  Law  and
          Code, it is,

          ORDERED, that  this  proceeding  be,  and  the  same  hereby  is,
          terminated.
