            ORDER AND OPINION GRANTING PETITION FOR ADMINISTRATIVE REVIEW

               The above-named owner filed a timely petition for 
          administrative review of an order issued concerning the housing 
          accommodations known as 4660 Manhattan College Parkway, various 
          apartments, Bronx, N.Y.

               The Commissioner has reviewed all the evidence in the record 
          and has carefully considered that portion of the record relevant to 
          the issues raised by the petition.

               The issue before the Commissioner is whether the 
          Administrator's order was correct.

               The Administrator's order being appealed, EH620029BO, was 
          issued on September 27, 1991.  In that order, the Administrator 
          affirmed the finding of DJ622553BR, issued August 3, 1990, that the 
          owner be denied eligibility for a 1990/91 Maximum Base Rent (MBR) 
          increase, due to the owner's failure to meet the violation 
          certification requirements necessary to the owner's being granted 
          an MBR increase.

               On appeal, the owner contends that all violations at the 
          subject premises have been repaired.  As proof the owner submits on 
          appeal a copy of a report of an inspection of the subject premises 
          conducted on or about June 4, 1991 by the New York City Department 
          of Housing Preservation and Development, said report stating on its 
          face that all violations at the subject premises were either 
          "dismissed" and/or "cleared."

               The Commissioner is of the opinion that this petition should 
          be granted.

               The Commissioner notes that the owner had similarly maintained 
          that violations had been cleared below, during both the 
          Certification and Challenge phases of this proceeding.  At 
          Challenge the owner submitted as proof an affidavit by the 
          superintendent of the subject premises in which the affiant 
          testified to the repair of specific violations.

               The Commissioner is of the opinion that the evidence submitted 
          by the owner at all stages of this proceeding, taken as a whole 
          tends to indicate that the owner cleared a sufficient number of 
          violations from the subject premises to cause the Administrator to 
          grant the owner eligibility to raise MBRs at the subject premises 
          for 1990/91.

               THEREFORE, in accordance with the provisions of the Rent and 
          Eviction Regulations, it is 

               ORDERED, that this petition for administrative review be, and 
          the same hereby is, granted, and that the order of the Rent 
          Administrator be, and the same hereby is, revoked.  This order is 
          issued subject to all the Terms and Conditions listed on the 
          attached page.
