          ORDER AND OPINION TERMINATING PETITION FOR ADMINISTRATIVE REVIEW
                                       AS MOOT


          On September 21, 1992, the above-named petitioner-owner filed a 
          petition for administrative review (PAR) of an order issued on 
          August 31, 1992, by the Rent Administrator, concerning the housing 
          accommodation known as 94-05 222nd Street, Apartment 5-H, Queens 
          Village, New York, wherein the Administrator determined that the 
          owner had not been served with all of the tenant's complaints under 
          Docket No. CK120793S and modified that order, effectively revoking 
          the rent reduction contained therein.

          The Commissioner has reviewed all of the evidence in the record and 
          has carefully considered that portion of the record relevant to the 
          issue raised by the administrative appeal.

          In the PAR, the owner contends that the Administrator's order here- 
          under review involves the same items that were included in the 
          order under Docket No. CK120793S dated March 26, 1991, which order 
          has already been the subject of a petition for administrative 
          review.  The owner reaffirmed the information supplied in the 
          previous petition and asked that it apply in this case.  The owner 
          also stated that the conditions found by the Administrator are 
          items of routine maintenance that have been corrected on many 
          occasions, and that, among other things, it has been difficult to 
          obtain access to the apartment.

          The Commissioner is of the opinion that this petition should be 
          terminated.

          The Administrator's order hereunder review effectively revoked the 
          rent reduction which had been granted in Administrator's Order 
          CK120793S.  In addition the Commissioner's order issued under 
          Docket No. DI110206RO revoked the same Administrator's order on the 
          basis that the conditions cited therein had previously been the 
          subject of a rent reduction order and, in addition, because it 
          could not be established from the record that the owner had been 
          properly served with all of the tenant's complaints.


          THEREFORE, pursuant to the City Rent Law and the Rent and Eviction 
          Regulations, it is,

          ORDERED, that this petition be, and the same hereby is, terminated 
          in accordance with this Order and Opinion.
