ORDER AND OPINION TERMINATING PROCEEDING
On July 23, 1992, the above-named petitioner-owner filed a
petition for administrative review against an order issued on July
8, 1992, by the District Rent Administrator, Gertz Plaza, Jamaica,
New York, concerning housing accommodations known as various
apartments located at 107 Brooklyn Avenue, Brooklyn, New York
wherein the Administrator denied the owner's application for an
order establishing 1992-1993 Maximum Base Rents for the rent
controlled apartments in the subject building.
The Commissioner finds that the petitioner has filed a
challenge to the denial of his application. The Commissioner notes
that said challenge (to which docket number GG 220088 BO has been
assigned) has not been determined. Since said challenge is still
pending, the Commissioner finds that the instant Petition is filed
prematurely and should, therefore be terminated.
Therefore, the Commissioner finds that the proceeding brought
on by the filing of the instant Petition and assigned Docket Number
GG 220163 RO should be terminated as premature.
THEREFORE, pursuant to all of the applicable statutes and
regulations, it is
ORDERED, that this proceeding be, and the same hereby is,
terminated.
