          The above-named petitioner-tenant filed a petition for 
          Administrative Review against the above-cited order of the District 
          Rent Administrator which granted the owner's application for  rent 
          increase based upon major capital improvements.                    
                          
          Pursuant to Section 2529.12 of the Rent Stabilization Code, the 
          filing of a Petition for administrative review automatically stays 
          the retroactive portion of the District Rent Administrator's order 
          (Temporary Rent Increase).

          Therefore, no further stay of this portion of the order is 
          required.

          Insofar as the District Rent Administrator's order prospectively 
          increased rents (Permanent Rent Increase) it is not automatically 
          stayed by the filing of a petition for administrative review.  The 
          Commissioner finds that a stay of this portion of the order is not 
          warranted.

          If the Petition for Administrative Review is denied by the 
          Commissioner, a new directive will be issued.  Pending the 
          determination of this petition, the order of the District Rent 
          Administrator is hereby stayed as above set forth.  In all other 
          respects, the order appealed from remains in full force and effect.
