ORDER AND OPINION TERMINATING PETITION FOR ADMINISTRATIVE REVIEW
PROCEEDING
On May 28, 1992, the above named petitioner-tenant timely refiled
a petition for administrative review (PAR) against an order issued
on April 22, 1992, by a Rent Administrator concerning the housing
accommodations known as 41-40 Denman Street, Apt. 6K, Elmhurst, New
York, wherein the Rent Administrator determined that the owner was
entitled to a rent increase based on the installation of a major
capital improvement (MCI).
In his PAR, the petitioner has not set forth any issues involving
any error in fact or law with regard to the Rent Administrator's
order but merely states that he is a Senior Citizen who cannot
afford the rent increase herein.
As stated in the Administrator's order, a Senior Citizen possessing
a valid Senior Citizen Rent Increase Exemption (SCRIE) may not have
to pay part or all of a rent increase which causes the total rent
to exceed one third of the tenant's income.
Until such time that the tenant is granted a SCRIE, he is under the
obligation to pay the MCI rent increase established by the Rent
Administrator in the proceeding below.
There are no other issues to be addressed by the Commissioner in
this administrative appeal.
THEREFORE, in accordance with the Rent Stabilization Law and Code,
it is

ORDERED, that this administrative review proceeding be, and the
same hereby is, terminated.
