          ORDER AND OPINION TERMINATING PROCEEDING COMMENCED BY THE  FILING
          OF THE PETITION FOR ADMINISTRATIVE REVIEW ASSIGNED DOCKET  NUMBER
          GA 220248 RT  AND  REFERRING  MATTER  TO  THE  ADMINISTRATOR  FOR
          CONSIDERATION OF COMMENCEMENT OF PROCEEDING UNDER SECTION 2200.22 
                        OF THE RENT AND EVICTION REGULATIONS
                                          
                                          

          The above-named petitioner-tenant timely  filed  a  Petition  for
          Administrative Review against an  order  issued  on  January  16,
          1992, by the Rent Administrator  at  Gertz  Plaza,  Jamaica,  New
          York, concerning housing accommodations known as Apartment #4  at
          621 Park Place, Brooklyn, New  York,  wherein  the  Administrator
          terminated the proceeding commenced by the tenant's  request  for
          information as to the status of his apartment.


          The Commissioner has reviewed all of the evidence in  the  record
          and  has  carefully  considered  that  portion  of  the  evidence
          relevant to the issues raised in the administrative appeal. 

          The issue in this appeal is whether the Administrator's order was 
          issued in error.

          The proceeding below was originally commenced on August  8,  1988
          by  the  petitioner's   filing   a   Request   for   Registration
          Information. Docket Number CH  220090  U  was  assigned  to  that
          proceeding. It was  terminated  on  November  3,  1988  when  the
          petitioner was advised by  the  Administrator  that  the  subject
          building appeared to be a four family house and, therefore, would 
          not  be  subject  to  the  registration  requirements  for   rent
          stabilized apartments.  Upon  receiving  said  notification,  the
          tenant wrote to the Administrator, on November 9, 1988, and asked 
          that the matter be re-opened. The tenant alleged that  he  was  a
          rent controlled tenant, who had taken occupancy in  1956, and  he
          asked that the Administrator check the registration card for  his
          apartment and advise him what his legal rent was. Thereupon,  the
          Administrator opened a proceeding to inquire into the  status  of

          the subject apartment vis a vis the City Rent [Control]  Law  and
          the Rent and Eviction Regulations. Docket Number CK 220117 UT was 
          assigned to that proceeding. 

          The proceeding assigned Docket Number CK 220117 UT was terminated 
          by the  appealed  order,  which  reads,  in  pertinent  part,  as
          follows:

               A review of the records on file in this Office revealed 
               that the subject apartment was decontrolled pursuant to 
               Section 9/11 [what is now Section 2200.2 (f)(11) of the 
               Rent and Eviction Regulations] as per Order  issued  on
               July 26, 1956 under Docket DR14252. If you  [petitioner
               herein] feel that your apartment is rent controlled you 
               must request an Administrative  Determination  pursuant
               to Section 2202.22 of the Regulations.

          In the Petition, the tenant claims that he rented  the  apartment
          on July 21, 1956; and that the fact that the subject apartment is 
          rent controlled was determined in the  April  20,  1989   Housing
          Court stipulation entered into between the tenant and  the  prior
          owner named Joseph St. Rose. The  tenant  has  attached  what  he
          alleges is a copy of  that  stipulation  to  the  Petition.  Also
          attached to the Petition is a  purported  copy  of  the  tenant's
          initial lease, dated July 21, 1956 for  a  one  year  term  which
          commenced on that date and terminated on July 20, 1957.

          Although afforded the opportunity to do so,  the  owner  has  not
          filed an answer to the petition.

          The Commissioner is of the opinion that the proceeding  commenced
          by the filing of the tenant's Petition for Administrative  Review
          should be terminated and that this matter should be  referred  to
          the Administrator for the commencement by the  Administrator,  on
          his own initiative (sua sponte), of a  proceeding  under  Section
          2202.22 of the Rent and Eviction  Regulations  to  determine  the
          status of the subject housing accommodation.  

          In disposing of this proceeding in this fashion, the Commissioner 
          notes that the Administrator took no action in the appealed order 
          other than advising the tenant of  what  the  Division's  records
          appear to indicate as to whether or not the subject apartment  is
          rent controlled and terminating the proceeding; which in fact was 
          merely a procedural  structure  within  which  the  Administrator
          responded to the tenant's inquiry. Once the requested information 
          had been transmitted to  the  tenant,  it  was  correct  for  the
          Administrator to terminate that proceeding. The Commissioner also 
          notes that by presenting  a  lease  which  commenced  before  the
          issuance of the purported  decontrol  order  and  a  stipulation,
          which appears to be initialed by a Housing Court  Judge,  wherein
          a prior landlord agreed that the  subject  apartment  is  a  rent
          controlled apartment, the tenant has made a sufficient showing to 
          warrant the Division's initiating  a  further  inquiry  into  the
          status of this apartment. 

          THEREFORE,  pursuant  to  all  of  the  applicable  statutes  and
          regulations, it is

          ORDERED, that the proceeding  commenced  by  the  filing  of  the

          tenant's  Petition  for   Administrative   Review   against   the
          Administrator's order issued under Docket Number CK 220117 UT be, 
          and the same  hereby  is  terminated  and  that  this  matter  is
          referred to the Administrator for consideration of initiating  an
          inquiry  under  Section  2200.22  of  the   Rent   and   Eviction
          Regulations as to the subject apartment.
