ORDER AND OPINION TERMINATING PROCEEDING
On October 16, 1991 the above named petitioner-owner filed a petition
for administrative review against an order issued on September 19, 1991
by the Rent Administrator concerning the housing accommodations known as
#5B at 203 West 107th Street, New York, New York.
On October 15, 1992, in a court of competent jurisdiction, the landlord
and tenant entered into a stipulation of settlement whereby the tenant
agreed to withdraw and/or waive her right to enforce the order on her
overcharge complaint with the DHCR, Docket #GB410564R, and the owner
agreed to withdraw and/or waive his right to the instant DHCR petition
for administrative review, Docket # FJ410272RO.
The Commissioner is of the opinion that the owner's petition for
administrative review should be terminated based on the owner's
withdrawal.
THEREFORE, in accordance with the Rent Stabilization Law and Code, it is
ORDERED, that the owner's petition for administrative review be, and the
same hereby is, terminated based on the owner's withdrawal.
