           ORDER AND OPINION DENYING PETITION FOR ADMINISTRATIVE REVIEW

        On May 13, 1991, the above-named owner filed a timely  petition  for
        administrative  review  of  an  order  issued  on  April  10,   1991
        concerning t e  housing  accommodations  relating  to   the   above-
        described docket number.  

        On November 13, 1990, various tenants commenced this  proceeding  by
        filing a complaint asserting that the owner had failed  to  maintain
        certain services in the subject apartment.

        On December 10, 1990, the tenants further confirmed that  the  owner
        has continued to fail to maintain services.

        In its answer filed on December 12, 1990, the  owner  asserted  that
        all required repairs had been completed.

        Thereafter on February 26, 1991 and March 1,  1991,  inspections  of
        the subject  apartment  were  conducted  by  a  DHCR  inspector  who
        confirmed the existence of defective conditions.

        On April 10, 1991, the Administrator directed restoration  of  these
        services and further ordered a reduction of the stabilization rent.

        In  this  petition,  the  owner  alleges  that  repairs  have   been
        performed.

        The Commissioner is of the opinion  that  this  petition  should  be
        denied.

        The owner's petition admits that repairs were made on May  6,  1991,
        after  the  issuance  of  the  Administrator's  order.    Then   the
        Administrator's order based on  the  inspection  at  that  time  was
        correct when issued, and this order is issued without  prejudice  to
        the owner filing an application for restoration of services.

        THEREFORE,  in  accordance  with  the   provisions   of   the   Rent
        Stabilization Law and Code and the Rent and Eviction Regulations, it 
        is

        ORDERED, that this petition for administrative review  be,  and  the
        same hereby is, denied, and that the order of the Rent Administrator 
        order be, and the same hereby is, affirmed.
