           ORDER AND OPINION DENYING PETITION FOR ADMINISTRATIVE REVIEW

        On May 8, 1991, the above-named owner filed a  timely  petition  for
        administrative review of an order issued on May 1, 1991,  concerning
        the housing accommodations relating to  the  above-described  docket
        number.  

        The Commissioner has reviewed all the evidence in the record and has 
        carefully considered that portion of  the  record  relevant  to  the
        issues raised by the petition.

        On December 12, 1990,  the  tenant   commenced  this  proceeding  by
        filing a complaint asserting that the owner had failed  to  maintain
        certain services in the subject premises.

        In its answer filed on January 16, 1991,  the  owner  asserted  that
        "all is OK."

        Thereafter on March 6, 1991, an inspection of the subject  apartment
        was conducted by a D.H.C.R. inspector who confirmed the existence of 
        defective conditions.

        On May 1, 1991, the Rent Administrator directed restoration of these 
        services and further ordered a reduction of the stabilization rent.

        In its petition for administrative  review,  the  owner  states,  in
        substance, that the tenant refused access for repairs.

        In reply, the tenant stated on  May  21,  1991  that  the  defective
        conditions still exist.

        After careful consideration, the Commissioner is of the opinion that 
        the petition should be denied.

        The record clearly shows that on March 6, 1991, inspection found the 
        defective conditions in question.   Accordingly,  the  Administrator
        properly  determined  diminutions  of   service,   warranting   rent
        reduction.

        As  to  the  owner  alleging  that  tenant   refused   access,   the
        Commissioner finds this allegation belied by  the  record.   In  the
        proceeding below, the owner  never  raised  this  defense  but  even
        contradicted itself by asserting that "all is OK."  The  owner  only
        raised this defense  for  the  first  time  as  a  self-serving  and
        unproven assertion on appeal.  The owner failed to  submit  to  DHCR
        copies of two letters to the tenant  attempting  to  arrange  access
        dates pursuant to  Policy  Statement  (90-5)  "Arranging  Repairs/No
        Access Inspections."  The owner thus failed to rebut the  inspection
        which formed the basis of the order appealed from.

        THEREFORE, in accordance with the Rent Stabilization Law  and  Code,
        it is

        ORDERED, that this petition be, and the same hereby is, denied,  and
        that the District Rent Administrator's order be, and the same hereby 
        is, affirmed.
