                     ORDER AND OPINION TERMINATING PROCEEDING

        On April 1, 1991, the above-named petitioner-tenant filed a Petition 
        for Administrative Review (PAR) against an order issued on April  1,
        1991, concerning the housing accommodation  known  as  330  West  55
        Street, New York, New York, wherein the Administrator  restored  the
        tenant's rent previously reduced under Docket No.  DH-430029-RP,  in
        an order dated December 26, 1989.  

        In the petition the tenant claims that the owner was in violation of 
        the underlying rent reduction order in  that  the  owner  failed  to
        credit the tenant with the retroactive part of  the  rent  reduction
        order.

        The Commissioner  notes  that  a  PAR  filed  by  the  owner  stayed
        automatically the retroactive portion of the rent  reduction  order.
        The Commissioner further notes that, the  Commissioner  granted  the
        owner's Petition for Administrati e  Review  under  Docket  No.  BF-
        410010-RO,  revoked  the  rent  reduction  previously  granted,  and
        remanded  the  proceedings  for  a  new   determination   de   novo.
        Accordingly, questions  of  non-compliance  with  a  rent  reduction
        order,  improperly  raised  in  the  tenant's  appeal  of  the  rent
        reduction order, have been rendered moot.

        THEREFORE, in accordance with the provisions of Chapter 403, Laws of 
        1983, as amended by Chapter 102, Laws of 1984, it is

        ORDERED, that the petition be terminated as moot, in accordance with 
        the above.
